These Terms and Conditions set out the basis on which Rubbish Removal Lewisham provides waste collection and rubbish removal services to domestic and commercial customers. By making a booking, accepting a quotation, or allowing our operatives to commence work, you agree to be bound by these Terms and Conditions.
In these Terms and Conditions, the following expressions have the meanings set out below:
1.1 Customer means the person, company or organisation that requests or receives waste collection, rubbish removal or associated services from Rubbish Removal Lewisham.
1.2 Services means any rubbish removal, waste collection, loading, transportation, recycling, disposal or associated services provided by Rubbish Removal Lewisham.
1.3 Waste means any items, materials, rubbish, junk, debris or other matter that the Customer asks Rubbish Removal Lewisham to collect and remove.
1.4 Contract means the agreement between the Customer and Rubbish Removal Lewisham comprising these Terms and Conditions and any specific details confirmed in writing or verbally at the time of booking.
2.1 Rubbish Removal Lewisham provides waste collection and disposal services including, but not limited to, household rubbish removal, bulky waste clearance, garden waste removal, office and commercial clearances, and general waste collection.
2.2 The exact scope of Services will be as described at the time of booking and confirmed in any quotation or booking confirmation issued by Rubbish Removal Lewisham.
2.3 Rubbish Removal Lewisham reserves the right to refuse to collect certain items where it is unsafe, unlawful or impractical to do so, including but not limited to hazardous waste, certain electrical items, medical waste, asbestos, chemicals and pressurised containers.
3.1 Bookings for rubbish removal and waste collection may be made by telephone, email or other communication methods offered by Rubbish Removal Lewisham.
3.2 The Customer must provide accurate information about the type, approximate quantity, location and accessibility of the Waste when making a booking. This includes details of any heavy, bulky or awkward items, limited access, parking restrictions or other factors that may affect the performance of the Services.
3.3 Any quotation provided prior to arrival is based on the information supplied by the Customer. If the details given are inaccurate or incomplete, the quotation may be revised on site after inspection of the Waste.
3.4 A booking is only confirmed when Rubbish Removal Lewisham has accepted the request and provided a booking confirmation with an estimated arrival date and time window. Time slots are indicative and not guaranteed, although reasonable efforts will be made to arrive within the agreed period.
3.5 Rubbish Removal Lewisham reserves the right to reschedule or refuse a booking where necessary due to operational, safety or regulatory reasons. In such cases, the Customer will be informed as soon as reasonably possible.
4.1 The Customer must ensure safe and reasonable access to the property and the Waste at the agreed time. This includes providing accurate address details, access instructions and any necessary permissions for parking or entry.
4.2 The Customer is responsible for securing any permits or authorisations required for loading or parking, where applicable. Any penalty charges arising from incorrect instructions or lack of permits may be charged to the Customer.
4.3 If access is obstructed or unsafe, or if the Waste cannot be removed as described at the time of booking, Rubbish Removal Lewisham may cancel or postpone the visit and may charge a call-out or waiting fee.
4.4 The Customer must not include hazardous or prohibited items within the Waste unless previously agreed and authorised by Rubbish Removal Lewisham in accordance with applicable regulations.
5.1 Prices are generally based on the volume and type of Waste, the weight where applicable, and the labour required for loading and removal. Additional charges may apply for difficult access, additional labour, staircase work, or special handling requirements.
5.2 Any quotation given before the team arrives is an estimate only and is not binding until the Waste has been inspected by the attending operatives. The final price will be confirmed on site before the Services are carried out, based on the actual volume, weight and nature of the Waste.
5.3 All prices are stated in pounds sterling and may be subject to value added tax or other applicable taxes, which will be added at the prevailing rate, if applicable.
5.4 If the Customer declines the revised price following on-site assessment, Rubbish Removal Lewisham reserves the right to charge a call-out fee to cover time and travel costs.
6.1 Payment is due on completion of the Services unless otherwise agreed in writing in advance. For certain bookings, Rubbish Removal Lewisham may require part or full payment in advance or may request a deposit.
6.2 Accepted payment methods will be communicated at the time of booking and may include cash, card payment, bank transfer, or other methods offered by Rubbish Removal Lewisham.
6.3 Where credit terms are agreed for commercial Customers, invoices must be paid in full within the agreed period. Interest may be charged on overdue amounts at the maximum rate permitted by law, along with any reasonable costs incurred in recovering the debt.
6.4 The Customer is responsible for ensuring that funds are available and that payment details are correct. If a payment is declined or reversed, Rubbish Removal Lewisham may suspend Services and seek immediate settlement of any outstanding sums.
7.1 The Customer may cancel or amend a booking by contacting Rubbish Removal Lewisham using the same method as used to make the booking or through any other communication method provided for this purpose.
7.2 Cancellations or changes made at least 24 hours before the scheduled arrival time will usually be accepted without charge, unless otherwise stated at the time of booking.
7.3 Rubbish Removal Lewisham reserves the right to apply a cancellation fee where a booking is cancelled with less than 24 hours notice, or where the team arrives on site but is unable to carry out the work due to circumstances within the Customer's control, such as lack of access or refusal of the revised price after misdescription of Waste.
7.4 If Rubbish Removal Lewisham cancels a booking due to operational or safety reasons, any payment or deposit already received in respect of that booking will be refunded, or the booking will be rescheduled by agreement with the Customer. Rubbish Removal Lewisham is not liable for any additional costs or losses arising from such cancellation.
8.1 Rubbish Removal Lewisham operates in accordance with applicable waste management, environmental and duty of care regulations in the United Kingdom.
8.2 All Waste collected will be transported and disposed of using authorised facilities. Where possible, Waste will be reused or recycled in preference to landfill, subject to the nature of the materials and the facilities available.
8.3 The Customer confirms that they have the right to authorise the removal of the Waste and that the Waste does not include prohibited or illegal items.
8.4 Rubbish Removal Lewisham may, at its discretion, refuse to collect any items that appear to be hazardous, contaminated or otherwise unsuitable, or may require additional charges and specific arrangements where special disposal procedures are necessary.
8.5 Once Waste has been removed by Rubbish Removal Lewisham, ownership of that Waste transfers to Rubbish Removal Lewisham. The Customer has no further claim over any items once they have been loaded onto the vehicle and the Customer has accepted the Service.
9.1 The Customer is responsible for securing or removing any items that they do not wish to be removed as Waste. Rubbish Removal Lewisham accepts no liability for the accidental removal of items where those items were not clearly separated from the Waste or where it was reasonable to assume they formed part of the load.
9.2 Rubbish Removal Lewisham will use reasonable care when carrying out the Services but is not responsible for pre-existing damage or for damage that could not reasonably be avoided due to the nature of the Waste, restricted access or the condition of the property.
9.3 The Customer should notify Rubbish Removal Lewisham of any fragile surfaces, fixtures or fittings that may require special care. Additional charges may apply where extra protection, labour or time is required.
10.1 Nothing in these Terms and Conditions limits or excludes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other matter that cannot be excluded or limited by law.
10.2 Subject to clause 10.1, Rubbish Removal Lewisham will not be liable for any indirect, special or consequential loss, any loss of profit, revenue, business or opportunity, or any loss of enjoyment arising out of or in connection with the Services.
10.3 Rubbish Removal Lewisham's total aggregate liability for any claim arising out of the Services or the Contract, whether in contract, tort or otherwise, will be limited to the total price paid or payable for the specific Service giving rise to the claim.
10.4 Rubbish Removal Lewisham is not liable for any delay or failure to perform its obligations where such delay or failure is due to circumstances beyond its reasonable control, including but not limited to traffic conditions, severe weather, accidents, public events, industrial actions or acts of authorities.
11.1 If the Customer is dissatisfied with any aspect of the Services, they should contact Rubbish Removal Lewisham as soon as possible, providing full details of the issue, including the date of service and any supporting information.
11.2 Rubbish Removal Lewisham will investigate complaints promptly and will, where appropriate, offer a remedy such as a partial refund, re-attendance or other proportionate resolution. Any remedy offered will be at the discretion of Rubbish Removal Lewisham and subject to applicable law.
11.3 Complaints relating to alleged damage must be reported as soon as reasonably possible and no later than 48 hours after completion of the Services, accompanied by clear evidence of the damage and any relevant supporting documentation.
12.1 Rubbish Removal Lewisham will collect and process personal data provided by the Customer for the purpose of managing bookings, delivering Services, processing payments, and handling enquiries and complaints.
12.2 Personal information will be handled in accordance with applicable data protection legislation in the United Kingdom. Data may be shared with third parties where necessary for providing the Services, processing payments or meeting legal obligations.
12.3 The Customer is responsible for ensuring that any personal data they provide is accurate and up to date.
13.1 Rubbish Removal Lewisham may update or amend these Terms and Conditions from time to time. Any changes will take effect when published or otherwise communicated and will apply to new bookings made after that date.
13.2 The version of the Terms and Conditions in force at the time of booking will apply to that particular Contract, unless a change is required by law or regulatory authority, in which case the amended terms may apply to existing Contracts to the extent required.
14.1 If any part of these Terms and Conditions is found to be invalid, unlawful or unenforceable by a court or competent authority, that part will be treated as removed, and the remaining provisions will continue in full force and effect.
15.1 These Terms and Conditions and any Contract between the Customer and Rubbish Removal Lewisham, as well as any disputes or claims arising out of or in connection with them, are governed by and construed in accordance with the laws of England and Wales.
15.2 The courts of England and Wales will have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Services provided by Rubbish Removal Lewisham.
16.1 These Terms and Conditions, together with any written or verbal confirmation of booking and any agreed quotation, constitute the entire agreement between the Customer and Rubbish Removal Lewisham regarding the provision of rubbish removal and waste collection services.
16.2 The Customer acknowledges that they have not relied on any statement, promise or representation that is not expressly set out in these Terms and Conditions or in the booking confirmation.
By booking or using the Services of Rubbish Removal Lewisham, the Customer confirms that they have read, understood and agree to these Terms and Conditions.
